Deals & Cases[Cross-Border Inheritance] Advising US Resident Heirs on the Inheritance of Korean Assets

SOMA Law Group successfully represented three US citizen children (heirs) residing in the U.S. in the inheritance proceedings of their late father, a dual citizen of Korea and the U.S. Our mandate included comprehensive financial asset tracing and advising on the drafting and execution of the Family Settlement Agreement (or Inheritance Divison Agreement, 상속재산분할협의서).

The decedent’s estate in Korea comprised diverse assets, including real estate, bank deposits, insurance, and automobiles. As all the children resided in the U.S., the key was to navigate the complex "non-resident inheritance" procedures while facilitating a smooth settlement with the Korea-based spouse (stepmother).

Procedural Difficulties for Non-Resident Heirs

Inheritance proceedings involving overseas residents present unique legal and administrative challenges unlike domestic cases:

  • Absence of Registered Seals ("Ingam"): Inheritance procedures in Korea strictly require the "Registered Seal" ("Ingam") and its certificate. U.S. residents, lacking this system, must provide a set of substitute documents to validate their intent.

  • Varying Institutional Requirements: Registry offices, banks, insurance companies, and vehicle registration bureaus may each require different forms of Power of Attorney (POA) with specific scopes of authority. Unless the documents are tailored, it often leads to rejection by such institutions, causing significant delays and costs (e.g., the need to re-notarize and re-send documents from the US).

SOMA’s Expertise

SOMA Law Group, specialized in cross-border inheritance and private client matters, provided a  one-stop solution for non-residents, enabling the clients to finalize the inheritance without entering Korea.

  • Asset Tracing: Through a comprehensive financial inquiry, we identified the full scope of the decedent's estate - including dormant accounts and insurance benefits - to establish a clear and accurate basis for division.

  • Drafting the Family Settlement Agreement (Inheritance Division Agreement): We drafted an agreement for the US-based children and the Korean spouse. The language was crafted with legal precision to preclude future disputes and ensure immediate acceptance by Korean registry offices.

  • Execution & Documentation: We provided a turnkey documentation service. SOMA drafted all necessary POAs and Affidavits, requiring the clients only to sign them before a local US notary. By coordinating directly with Korean institutions, we ensured a seamless process, eliminating the hassle of repeated document preparation.

With SOMA, the heirs reached an amicable agreement without dispute and finalized the signing of the Family Settlement Agreement (Inheritance Division Agreement).

This case highlights SOMA’s know-how tailored for international clients. Bridging the gap between Korean civil procedure and foreign notarization systems, we provide non-resident heirs with the safest and most efficient pathway to secure their Korean inheritance assets.
